Position Summary

Provides legal counsel to Xcel Energy and its subsidiaries and manages outside counsel on Federal Energy Regulatory Commission (FERC) matters. Handles both routine and complex legal matters with minimal assistance from other attorneys, and manages outside counsel for legal support when needed. The attorney will be responsible for a range of FERC matters, including wholesale transactional matters, transmission and interconnection service issues, formula rate matters, FERC enforcement matters, and NERC reliability matters.

Essential Responsibilities

  • Represent Xcel Energy and its Operating Companies in FERC rate filings, transactional regulatory approvals, tariff amendments, market based rate matters, FERC rulemakings, and Regional Transmission Organization (RTO) proceedings.
  • Advise Xcel Energy and its Operating Companies in FERC compliance matters, including transmission matters, wholesale production matters, and corporate affiliation rules.
  • Represent Xcel Energy in FERC electric litigation, including section 205 and 206 proceedings under the Federal Power Act, and including matters involving Xcel Energy's operating companies both inside and outside of RTOs.
  • Represent Xcel Energy in federal appellate proceedings involving FERC decisions.
  • Represent Xcel Energy in FERC enforcement proceedings.

Principal Attorney Minimum Requirements

  • Juris Doctorate degree from ABA accredited law school.
  • 6-10 years of practice in corporate law department, law firm, government practice or equivalent legal experience.

Assistant General Counsel Minimum Requirements

  • Juris Doctorate degree from ABA accredited law school.
  • Licensed to practice in state where position is located.
  • 10+ years of practice in corporate law department, law firm, government practice or equivalent legal experience.
  • Leadership experience required.

Preferred

  • Experience with both production and transmission formula rate proceedings at FERC.
  • Experience with FERC transactional and market-based rate matters.
  • Experience with RTO market rules, including MISO, SPP, or other RTOs, as well as RTO litigation including transmission cost allocation disputes.
  • Experience with FERC administrative litigation conducted before Administrative Law Judges.
